Jackson v. Jackson, 236 Va. 199, 372 S.E.2,d 155 (1988). After he lost a child custody dispute, Mr. Jackson swore out thee separate warrants against his former wife, our client. Each warrant was served on her and in one instance she was required to spend time in jail. However, all of the charges were groundless. (He claimed she had committed breaking and entering by going into a house they still owned together.) The Nelson County Circuit Court awarded compensatory and punitive damages against the ex-husband in our malicious prosecution suit. The Supreme Court agreed with that decision.
